Homework 2220: Homework on Miranda Rights

There are several readings. Most of them are relatively short. For the reading by Thomas & Leo ("The Effects of Miranda"), you don't need to read everything in there (although you are of course welcome to). From that reading, JUST READ 208-213, 219-222 (start with last paragraph on 219 "the Court's change in attitude..."), 228-232 (start with middle of 228, "By the 1980s..."), and read section IVC (245-256)

Please answer the following questions IN YOUR OWN WORDS. Please keep your answers brief when possible.

1. Give two pieces of evidence from the various readings that show that people do sometimes make false confessions. (2pts)

2. What legal police procedures are likely to elicit false confessions from people (briefly describe two)? Why? (2pts)

3. According to Thomas and Leo, the way that courts currently interpret the Miranda decision no longer really protects suspects' freedom of choice during interrogation. Give one piece of evidence that supports their view. (2pts)

4. Give three ways discussed by Thomas & Leo that police elicit confessions despite the rights guaranteed by Miranda. (2pts)

5. In your view, how often do suspects give morally relevant consent when they cooperate with the police during interrogation? Support your answer with evidence from the reading. (2pts)
